1. Acceptance of Terms

By creating an account or using PodcastCraft, you agree to these Terms of Service. If you don't agree, please don't use our Service.

You must be at least 18 years old or have reached the legal age of majority in your country to use PodcastCraft. By using our Service, you confirm that you meet this age requirement.

2. Description of Service

PodcastCraft provides AI-powered podcast transcription services including:

• Audio transcription with speaker identification
• Timestamped chapters and show notes
• Keyword and SEO tag generation
• Export to multiple formats

3. Payment and Credits

PodcastCraft operates on a pay-per-use model:

• No subscriptions - You purchase credits as needed
• Credits never expire - Use them at your own pace (see Section 7 for service discontinuation)
• Transparent pricing - Pay per credit used for transcription, keywords, and AI features
• Refund policy - Full refund on the Starter pack after your first episode if unsatisfied
• Payment processing - All payments handled securely via Stripe

4. Data Retention and Account Inactivity

We handle your data as follows:

• Audio files - Automatically deleted 24 hours after successful transcription to save storage space. All processed content (transcription, chapters, keywords, show notes) remains permanently available
• Orphaned uploads - Audio files uploaded but not transcribed are automatically deleted after 48 hours
• Transcriptions and processed content - Retained permanently while your account is active
• Inactive accounts - After 90 days without login, you'll receive a notification email
• Data deletion - After 180 days of inactivity, we may delete your data to optimize service performance
• Credits - Never expire under normal service operation, even if your account becomes inactive

You can export your data at any time from your dashboard before deletion.

5. Your Content

You are responsible for the audio files and other content you upload. By using PodcastCraft, you agree that:

• You own the content or have the necessary rights and permissions to use it
• Your content does not infringe any third party's intellectual property, privacy, or other rights
• Your content does not contain unlawful, defamatory, or harmful material
• You will use the Service only for lawful purposes
• You will not attempt to abuse, hack, or disrupt the Service
• You will not resell or redistribute our Services

We do not claim ownership of your content. By using our Service, you grant us a limited license to process your content solely for providing the Service (transcription, AI analysis, etc.). This license terminates when you delete your content or account.

Disclaimer: PodcastCraft disclaims any and all liability in connection with your content. You are solely responsible for your content and the consequences of uploading and processing it via the Service. We do not pre-screen, monitor, or review user content, and we are not responsible for any claims, damages, or losses arising from content you upload, including but not limited to claims of copyright infringement, defamation, or violation of privacy rights. AI-generated transcriptions and outputs may contain errors; you are responsible for reviewing and verifying all generated content before use.

6. Service Availability

We strive for 99.9% uptime but cannot guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability.

7. Service Discontinuation

We reserve the right to modify, suspend, or discontinue the Service at any time. In the event of a permanent discontinuation, we will notify you at least ninety (90) days in advance via the email address associated with your account. During this notice period, the Service will remain fully operational, allowing you to use any remaining credits and export your data. Upon expiration of the notice period, your access to the Service will end and any unused credits will expire.

8. Intellectual Property

The Service, including its original content, features, and functionality, is and will remain the exclusive property of PodcastCraft and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

9. Limitation of Liability

PodcastCraft is provided "as is" without warranties. We're not liable for indirect damages, lost profits, or data loss. Our maximum liability is limited to the total amount you have paid for the Service.

10. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless PodcastCraft and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your content, including any claim that your content infringes or violates any third party's intellectual property, privacy, publicity, or other rights
• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any third-party claim related to recordings you upload that were made without proper consent of all parties involved

This indemnification obligation will survive the termination of your account and these Terms.

11. Changes to Terms

We may update these terms occasionally. We'll notify you of significant changes via email. Continued use after changes means you accept the new terms.

12. Account Termination

You can delete your account at any time from your settings. We may suspend accounts that violate these terms. Unused credits are non-refundable upon voluntary account closure.

13. Governing Law

These Terms of Service are governed by the laws of Spain. Any disputes arising from these terms or your use of the Service shall be resolved exclusively in the courts of Tarragona, Spain.

If any provision of these Terms is found to be unenforceable or invalid by a court, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
